Terms of service.

These terms govern your use of vidakovicdigital.ca and your engagement with Vidakovic Digital services. Project-specific contracts are signed separately and take precedence over anything here.

Who we are

"Vidakovic Digital" refers to the sole proprietorship operated by Petar Vidakovic in Burlington, Ontario, Canada. References to "we" or "us" or "I" refer to the same business. References to "you" refer to website visitors and clients.

Use of this website

You may use vidakovicdigital.ca for personal and commercial purposes (e.g., research, contacting us about a project). You may not:

  • Copy, reproduce, or republish content from this site without written permission
  • Attempt to gain unauthorized access to the site or its systems
  • Use this site to send spam, malicious code, or harassment
  • Scrape the site for automated data collection without permission

Intellectual property

All content on this site — design, code, copy, photography, case studies — is the property of Vidakovic Digital unless otherwise noted. Client logos and case study material are used with permission of the respective businesses.

You may share links to pages on this site freely. For other uses, ask first.

Service engagements

Quotes and estimates

Quotes provided via email or this website are valid for 30 days from the date issued. Pricing on service pages is indicative — final pricing is confirmed in a written quote after a discovery call.

Project agreements

All client work is governed by a project-specific agreement signed by both parties before any work begins. The signed agreement takes precedence over anything on this website.

Payment terms

Standard payment terms are 50% deposit upfront, 50% on project completion, unless otherwise specified in your agreement. Hosting and recurring services are billed in advance. Invoices are due within 14 days of issue.

Late payment

Invoices unpaid after 30 days may incur a 2% monthly late fee. Repeated non-payment may result in suspension of services (e.g., taking down a hosted site) until accounts are settled.

Refunds

For one-time services (websites, audits, setup fees): work already performed is non-refundable. If you cancel a project mid-build, you'll receive a refund for any work not yet performed.

For recurring services (hosting, monthly management): cancel anytime. Pre-paid annual plans receive a prorated refund for unused months.

Project ownership

On full payment of an invoice for a website project, you own the source code and content of your site. The Git repository is transferred to you. There is no vendor lock-in.

Vidakovic Digital retains the right to display the work in its portfolio and case studies unless you explicitly request otherwise in your project agreement.

Third-party assets used in your project (stock photos, fonts, software libraries) remain governed by their respective licenses.

Limitation of liability

Services are provided on a best-efforts basis. While I take performance, accessibility, and security seriously, I make no guarantees about specific outcomes — for example, exact search rankings, conversion rates, or revenue increases.

Vidakovic Digital's total liability for any claim arising from services provided is limited to the amount paid by the client for the services in question.

I am not liable for indirect or consequential damages (e.g., lost profits, business interruption) except as required by Canadian law.

Third-party services

Some services depend on third-party platforms (e.g., Netlify for hosting, Google Ads for paid campaigns). I am not responsible for outages, policy changes, or actions taken by these third parties beyond my control. I'll always do my best to advocate for clients in such situations.

Confidentiality

Information shared with me during client engagements is treated as confidential. I won't share business strategies, internal documents, financial information, or technical credentials with anyone outside the engagement without your permission.

Termination

Either party may terminate an ongoing service engagement (e.g., monthly hosting, ad management) with 30 days' written notice. Project-based work follows the cancellation terms in the signed project agreement.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes are subject to the exclusive jurisdiction of the courts of Ontario.

Changes to these terms

I may update these terms occasionally. The "last updated" date at the top reflects the most recent change. Active clients will be notified of meaningful changes via email.
